As of February 12, 2005, this fumigant is permitted in or on 59 food commodities in the United States. The following list identifies the foods for which EPA has set pesticide tolerances. Sulfuryl fluoride is included in the category: "Fluorine compounds". Also included in this category is the insecticide Cryolite.

The following is applicable to tolerances for Sulfuryl Fluoride:

• On January 23, 2004, US EPA approved the first-time use of sulfuryl fluoride as a fumigant on food which permits the highest levels of inorganic fluoride on food commodities in its history.

• On March 23, 2004, Fluoride Action Network and Beyond Pesticides submitted formal objections to this approval.

• As of March 5, 2005, US EPA has not responded to these formal objections.

• It is not known if sulfuryl fluoride will be used as a fumigant before US EPA responds to the substantive objections submitted. Also, it is not known whether the State of California has approved its use.

• On March 4, 2005, the Federal Register published a new petition by Dow for sulfuryl fluoride tolerances.

• Sulfuryl fluoride requires two tolerances: one for inorganic fluoride levels and one for sulfuryl fluoride. These are presented below.

With this action, tolerances are established in association with the use of sulfuryl fluoride for the above commodities as a result of the treatment of areas and equipment within food and feed processing plants with sulfuryl fluoride for the control of insects. The term food and feed processing plant includes those facilities specifically listed under the Food and Feed Processing Plants subgroup within pesticide use site group 12 in Appendix A to 40 CFR part 158.
