Texas peanut farmers argued that during the 2000 growing season
Dow's newly marketed fluorinated diclosulam herbicide called
Strongarm severely damaged their crops. In their efforts to
create a Class Action suit, the farmers lost their case in
two courts.
They then appealed to the U.S. Supreme
Court. On April 27, 2005, the Supreme Court ruled
that
farmers whose crops are damaged by federally approved pesticides
or herbicides may pursue damage claims against the manufacturers
in state court.

on 110 acres of peanuts to evaluate the control of broadleaf
weeds and sedges in preplant incorporated, preemergence, and

only in the States of New Mexico and Texas. The EUP is effective

use permit allows the use of 2.67 pounds of the herbicide
on 86 acres of soybeans to evaluate the control of broadleaf
weeds and sedges. The program is authorized only in the States
of AL, AR, GA, KY, LA, MS, MO, NC, SC, TN, and VA. The experimental
use permit is effective from July 18, 1995 to March 1, 1997.
This permit is issued with the limitation that all treated
crops are destroyed or used for research purposes only. |
