On April 27, 2005, the U.S. Supreme court ruled that the farmers have a right to pursue damage claims against the manufactures in state court.

Diclosulam Dennis Bates, el al. v. Dow AgroSciences LLC. Texas peanut farmers allege that the diclosulam herbicide, Strongman, severely damaged their crops. In their efforts to create a Class Action suit, the farmers lost their case in two courts. In April 2005, the U.S. Supreme Court ruled in favor of the farmers. They said the farmers have the right to pursue damage claims against the manufacturers in state court. Dow AgroSciences, a 100%-owned subsidiary of Dow Chemical, makes diclosulam.

Initial Settlement

In February 2005, DuPont agreed to settle this suit with an initial $107.6 million payout and could eventually have to pay another $235 million, depending on the outcome of a community health study in Ohio.

PFOA

Class Action Suit: Residents in Ohio accused DuPont of contaminating their drinking water supplies with Ammonium perfluorooctanoate (APFO) originating from DuPont's Washington Works facility in Wood County, West Virginia. At this time in history APFO is considered to be the PFOA derivative of greatest concern and with the most wide-spread use.

Settled

August 2004: a $45 million settlement. About $21 million of the settlement went to court costs, administrative costs and lawyer fees. This settlement does not allow the farmers to sue for future health related effects.

Fipronil

Class Action Suit of Louisiana Crawfish Farmers. The farmers said that the fipronil insecticide Icon, used to treat rice seed, destroyed their crops and contaminated their fields in 2000 and 2001. The company that made Icon, Aventis Crop Sciences, argued drought conditions were to blame for the decline.

In 2001 Fipronil was owned by Aventis. Bayer bought out the Aventis crop protection business in 2002. At that time Bayer was forced to divest fipronil and sold it to BASF.
